Official Rules for Homes101's Closing Costs Contest

1. ELIGIBILITY
   Sweepstakes is currently offered only where permitted in the United States and its territories to legal United States residents at least 18 years old who purchase or sell real estate of any kind during the promotional period or 6 months from the date of award, whichever is sooner. Participants are not required to use the services of a HomeRoute.com real estate professional. Employees and directors of HomeRoute.com, their parents, affiliated and subsidiary companies and the immediate family or members of the same households of such employees and directors are not eligible. By entering, you agree to these Official Rules and the decisions of HomeRoute.com, which are final and binding in all respects. HomeRoute.com reserves the right to change, alter or modify the eligibility and prize structure at any time. This offer is not valid in AK, AZ, KS, KY, LA, MO, MS, NJ, OK, SD, WV or any other state where prohibited by law.
2. PROMOTIONAL PERIOD
   Promotional period begins on 5/17/01 at 5:00 a.m. Eastern Time (ET), and ends on 03/16/2008 at 11:59:59 p.m. ET ("Promotional Period"). Beginning with the month of August 2001, throughout the Promotional Period there will be one drawing per three-month period. Sponsor, however, reserves the right to terminate the promotion by giving notice, deemed appropriate by Sponsor, in which case the Promotion will terminate on the last day of that month.
3. ENTRY
   To enter you must fully complete a Find a Home, Free New Home Hotlist or Comparative Market Analysis (CMA) request form anywhere on our site. No participant can receive more than one entry for the entire promotional period. No responsibility is assumed for lost, late, incomplete, stolen, misdirected, or illegible entries; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, or service provider/Internet/web site/use net accessibility or availability, traffic congestion, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information.
4. DRAWING
   All winners for each drawing will be selected by random drawing from all eligible entries received for that drawing. The winner is to be notified by email, telephone, overnight carrier, or regular mail, within approximately 7 days of the drawing. Drawings will be conducted under the supervision of HomeRoute.com.
5. PRIZE/ODDS
   $1,000 Cash Rebate of Real Estate Closing Costs: There will be a total four prizes awarded for the entire Promotional Period: The winners shall be selected by random drawing from all eligible entries received during the Promotional Period. Each qualifying winner will receive $1000. Odds of winning in any drawing depend on the number of eligible entries received for that drawing. No assignment, transfer or substitution of prize is permitted. All prizes are expressed in U.S. Dollars. Taxes are the sole responsibility of winner.
6. GENERAL CONDITION
   Winners must execute and return an Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release within 5 days of notification. Failure to return documents timely, or if prize notification or prize is returned as non-deliverable, or if winner is found not to be in compliance with these Official Rules, or otherwise ineligible, disqualification may result with an alternate winner selected. Where permitted by law, winner agrees to grant to Sponsor, and those acting pursuant to its or their direction or control, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration; and further without such additional compensation, appear for, or provide biographical information for use in, any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews, as may be determined from time to time by Sponsor. Failure to make such appearances or grant such rights may result in disqualification with an alternate winner or potential winner selected; and while not obligated to do so, Sponsor may in its sole discretion, bear such reasonable costs and expenses which Sponsor, in its sole discretion, deems appropriate for winners or potential winners to appear for a presentation or other activity. By accepting a prize, a winner agrees that any Affidavit and/or Releases, and any grant of permission to use the winner's name, portrait, picture, voice, likeness and biographical information, as stated above, may be secured by Sponsor electronically, for example but not limited to, by email or by facsimile, and such secured Affidavit and/or Releases and permission will have the same force and effect as if any of them had been secured in a written document which was physically executed by the winner. Further, by accepting a prize, each winner releases and agrees to hold harmless Sponsor HomeRoute.com, and their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Sweepstakes related activity, or participation in this Sweepstakes. Void where prohibited. HomeRoute.com reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or web site; to be in violation of the Terms of Service of the web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and persons using any such methods will be disqualified. Sponsor will prosecute any fraudulent activities to the full extent of the law.
7. LIMITATIONS OF LIABILITY
   Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, or tampering or hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Sweepstakes for any drawing(s) and select the winner from entries received for that drawing prior to the action taken or in such other manner as Sponsor deems fair and equitable. IN NO EVENT WILL SPONSOR, HOMEROUTE.COM, OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF INTERNET SITE www.homes101.net OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 8. DISPUTES
   As a condition of participating in this Promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the City of Detroit having competent jurisdiction, which Court shall apply the laws of the State of Michigan without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.
9. WINNERS LIST
   For the name of the most recent winner, send a self-addressed stamped envelope for receipt by the 15th of the month for the prior 3 month winner to: Homes101 Winners List c/o HomeRoute.com, 5424 E Grand River Ave Suite#104, Howell, MI 48843. For Official Rules mail a self-addressed stamped envelope to the above address marked "OFFICIAL RULES" for receipt by 03/16/2008 or phone toll free 1-800-524-5805 by 11:59 p.m. ET on 03/16/2008. The name of the most recent winner will also be posted at http://www.homes101.net.
